Terms of Use

These terms cover your use of Kinnote, run by Surettech (Jeff Surette), a sole proprietorship based in Massachusetts, USA. By setting up a family or taking part in one, you agree to them. Kinnote is currently in beta, so some things will change.

Who can use Kinnote

You must be at least 18 to create a Kinnote account. A parent sets up the family and decides who to invite. The grown-ups who are invited can listen and reply, but cannot invite anyone else.

Accounts and sign-in

Parents sign in with Apple; there is no separate password. The grown-ups you invite join by tapping the link you text them — no account required. That link carries a private access token, so treat it like a key: anyone who has it can take part in that thread until you remove the person. Let us know promptly if you think a link has gone somewhere it shouldn’t.

Your content

The voice notes and other content your family creates belong to your family. You give us only the limited permission we need to store your content and deliver it to the people in your family — nothing more. We don’t claim ownership of it, and we don’t use it for any purpose beyond running the service. You’re responsible for the content you record and for confirming you have permission to add information about the people in your family.

Using Kinnote responsibly

Please use Kinnote only for its purpose — sharing voice notes within your family. Don’t use it to send unlawful, harmful, or infringing content, to harass anyone, to impersonate someone, or to attempt to break, overload, scrape, or gain unauthorized access to the service.

Beta and availability

Kinnote is provided on an “as is” and “as available” basis while in beta. Features may change or be removed, and the service may be interrupted. We’ll do our best to keep your family’s archive safe, but during beta you should not rely on Kinnote as your only copy of anything important to you.

Disclaimer of warranties

To the fullest extent the law allows, Kinnote is provided without warranties of any kind, whether express or implied. We don’t guarantee that the service will be uninterrupted or error-free, or that every recording will always be delivered or preserved.

Limitation of liability

To the extent the law allows, our total liability to you for any claim relating to Kinnote is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $100. Because Kinnote is free during beta, that amount is US $100 today. Nothing in these terms limits any liability that cannot be limited by law.

Ending your use

You can delete your account at any time from the app’s menu, which removes your family and content. We may suspend or end access that violates these terms or that we need to act on to protect the service or other families.

Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-laws rules.

Disputes

Let’s talk first. If something’s wrong, email [email protected] before filing anything, and please give us 30 days to make it right — most issues resolve quickly that way. Any dispute we can’t resolve informally will be brought exclusively in the state or federal courts located in Massachusetts, and you consent to their jurisdiction. You agree to bring any dispute in your individual capacity, and not as a plaintiff or class member in any class, consolidated, or representative action. We do not use binding arbitration.

Changes

We may update these terms as Kinnote develops. If we make material changes, we’ll update the date at the top of this page and, where appropriate, let you know in the app. Continuing to use Kinnote after that means you accept the updated terms.
